Property creators advertising rules: England video checks
Property creators advertising rules for England video releases: check relationships, label visibility, claim evidence and finance escalation before publication.
| Case | What must be checked | Release decision if unresolved |
|---|---|---|
| Paid, gifted or commissioned material | Relationship, responsible parties and label | Resolve the relationship before selecting a label |
| A separate clip, story or repost | Label visibility on the version viewers encounter | Correct the format or do not publish it |
| A property statement | Evidence, date, place, measure and limits | Remove or amend the unsupported claim |
| Consumer information or testimonials | Decision-relevant detail, records and rule status | Clarify the evidence or leave the material out |
| Finance wording or transaction activity | Specialist review and the actual activity involved | Pause the wording or route it for review |
| Final release | Approved version, evidence and live rendering | Hold publication if a required check fails |
Commercial relationship
Property creators advertising rules begin with establishing whether the material is paid, incentivised, commissioned or independent, then assigning a label that reflects the relationship. Log money, commission, gifts, discounts and other benefits before editing starts, and retain the record for release. An undisclosed commercial connection should not be presented as ordinary editorial.
Separate independent editorial from commissioned production, sponsorship, affiliate material and promotion of the creator's own business. The CMA's September 2025 creator guidance addresses payment, commission, gifts and other incentives; retain the relationship record with the advertising screen for the final asset.
Name advertiser, creator, agency, publisher and approver, rather than leaving responsibility assumed. CAP assigns obligations under section 1 to agencies and publishers involved in preparing marketing communications. Save that allocation beside contract responsibilities and the approval record for each published version.
Label visibility
The Ad label should appear where the viewer first meets the material, not only on a profile or elsewhere in a campaign. Put it on every standalone story, clip and repost, since each may be encountered separately. A format that cannot carry a clear label should not be used.
Test the label on the intended device and format before interaction, and name the person responsible for fixing a missing, obscured or detached label. The August 2026 CAP advice generally expects a prominent upfront label and warns that a platform tool may not always suffice; CAP Code rule 2.1 requires marketing communications to be obviously identifiable.
Claim proof
For every property claim, connect the exact impression to a capable source, publication date, England location, relevant unit and known limitation. Test footage, maps, captions and spoken wording together; remove or amend any statement the evidence owner cannot substantiate.
A Manchester two-bed rent comparison, for example, should identify the ONS release date, Manchester local-authority area, defined rent measure and index limits. It cannot be stretched into a claim about Greater Manchester, all rental homes or future changes; preserve this boundary in the review ledger.
ASA and CAP material on property marketing addresses descriptions, fees, comparisons and local-expertise claims. CAP Code section 3, including rule 3.7, covers substantiation, omissions and comparisons. Keep the assessment with the precise asset version, so reviewers can compare the evidence with the message that was actually approved.
Consumer decision point
Check what an average consumer needs before the relevant transactional decision, and do not let a testimonial imply more than its record supports. Keep authenticity, permission and any incentive details together; state whether relevant rules are final, proposed or older sector guidance rather than presenting an unsettled position as settled.
The CMA's Unfair commercial practices guidance for traders applies from 6 April 2025; the government's June 2026 property-listing consultation confirms there is no single prescribed residential list for every case. Do not invent a universal checklist to fill that gap; use risk scenarios to log exceptions and route unresolved information before the content goes live.
Finance and activity boundary
Mortgage, credit or investment wording needs a named FCA financial-promotion specialist, rather than routine caption approval. Route the exact wording and context to that reviewer before release; if the specialist has not cleared it, pause the finance claim instead of relying on a general property-content check.
Keep lead capture disabled until privacy and PECR reviewers approve the precise route. If the material introduces parties, negotiates or otherwise advances an instructed transaction, send the activity to a property solicitor; the relevant issue is what the work does, not simply how it is labelled.
The Estate Agents Act 1979 requires the real instructed activity to be examined. Preserve the solicitor's or specialist's decision with the release file, and do not use a general content approval to settle a question about transaction work or financial-promotion status.
Release record and consequences
Release only when the approved asset, label, evidence pack, rights, accessibility check and named withdrawal owner are recorded together. Recheck live facts and current regulator guidance on publication day, then keep the approval tied to the version that will appear publicly rather than to a draft or an earlier export.
The CMA can act under the Digital Markets, Competition and Consumers Act 2024, and from 6 April 2025 penalties can reach 10% of global turnover or £300,000, whichever is higher. The ASA may publish a ruling, require changes and refer persistent cases to Trading Standards.
The FCA can challenge unauthorised financial promotions under FG24/1 and FSMA section 21; stated consequences include fines, prohibitions or prosecution. Keep any specialist decision with the release file, and do not treat a platform disclosure control as a substitute for legal review or for identifying who approved the finance wording.
Inspect the final rendering on every intended device and retain proof alongside the asset version. If a platform crops, delays or hides information needed for the label or qualification, alter the creative or abandon that format. A failed required gate means pause; extra disclosure cannot repair missing authority, permission or substantiation.
The release workflow can retain decisions against a controlled version. Record who approved the final label and claim, and keep the evidence trail retrievable if challenged. A release file should connect the public material to its source checks, permissions and named owner for withdrawal, not merely preserve a copy of the finished video.
